MyPokerIntel: Terms and Conditions

MYPOKERINTEL TERMS OF USE

This agreement pertains to your use of mypokerintel.com ("We," "we," "us," or "our"). By using mypokerintel.com and/or signing up for an account, you agree to these terms.
1. USER ACCOUNT ACCESS
As part of your use of this Web site, you may elect to sign up for a user account. You agree that you are the only individual who will access the site using your account, and that you will not permit others to use your account to access the site (other users must create their own accounts).
2. FREE AND PAY SERVICES
mypokerintel.com offers free and paid subscription accounts, as well as the ability to browse our site without creating an account. We reserve the right to restrict or close your account and the use of our Web site at any time for any reason. You agree that, at our request, you will discontinue the use of our Web site. Paid subscriptions will be refunded according to our refund policy (see "Refunds").
3. COMMUNICATION WITH mypokerintel.com
All communications with mypokerintel.com should be e-mailed to support@mypokerintel.com. We will make our best effort to read and respond to your e-mail within two business days. If any request for cancellation of paid services is not processed in due time resulting in the inadvertent charge of an additional subscription fee, we will refund these charges in full.
4. REFUNDS
If for any reason you are not satisfied with your paid subscription, you may cancel it within three days from the date of signup for a full refund. After three days all paid subscription fees are non-refundable. If mypokerintel.com initiates the closing of your account, any subscription fees will be refunded on a pro-rated basis, based on the actual amount of days you were subscribed to the site, unless your account is closed because you violated the terms of this agreement (see "Violation of Terms").
5. VIOLATION OF TERMS
You agree that if you violate the terms of this agreement that your user account may be cancelled and you forfeit any refund on the remainder of your subscription.
6. MONTH-TO-MONTH PAID SUBSCRIPTIONS
If you sign up for a monthly subscription plan, your subscription will continue and renew automatically and billed to your credit card until we initiate or you request that we discontinue the renewal of your subscription (send your request to support@mypokerintel.com). Renewals will be billed to the credit card you used when you first signed up for service unless you request to cancel your service or change your billing options.
If, during the term of your month-to-month subscription you elect to purchase an upgraded subscription then your account will automatically renew at the upgraded rate (see "Upgraded Subscriptions"). When you purchase an upgraded subscription while currently subscribed to a month-to-month subscription, that subscription term will begin immedtiately. You will be billed on a pro-rated basis at the time of upgrade for the difference in fees betwteen the old and upgraded subscription for the current month. You will then be billed the new amount monthly (see "Month-to-Month Paid Subscriptions")
7. ONE-TIME PREMIUM SERVICES SUBSCRIPTIONS
mypokerintel.com may offer one-time premium reporting services. If you purchase a one-time premium service (e.g., Head-to-head Profit Analysis), you will be billed separately and only one time for each product. You may purchase as many one-time reports as you desire.
8. CONNECTING TO mypokerintel.com's WEB SITE
You and not mypokerintel.com are responsible for any fees or charges incurred to access our site through an Internet service provider.
9. PRIVACY
You agree that you've read our privacy notice and agree to its terms (http://www.mypokerintel.com/common/privacy.aspx).
10. COPYRIGHT; LIMITATIONS ON USE
All content on the site is copyright by mypokerintel.com or its rightful copyright owner(s). By using this site you agree not to republish or rebroadcast the content published herein (whether or not such content is copyright), as well as agree not to filter, alter, or frame the site or its content without the written permission of mypokerintel.com.
11. LINKS
You may link to any page on our site without asking, unless that page is a "paid subscribers only" page. Linking to such pages will not show that page to the user unless that user is a paid subscriber.
12. ACCURACY AND AVAILABILITY OF INFORMATION
We have created a database of Poker Player and Hand information as well as other content and, while we make our reasonable and best efforts to ensure the accuracy of the information, we give no warranty or guarantee as to its accuracy.
13. REPRESENTATION AND WARRANTIES
You represent and warrant to mypokerintel.com that you possess the legal right and ability to enter into this agreement and that all information submitted by you to the site is true and accurate. You also agree that you will not use the site for any purpose that is unlawful or prohibited by this agreement.
14. DISCLAIMER OF WARRANTIES
All content and services provided by mypokerintel.com are provided "as is." We do not make any warranties as to the availability of the site at any particular time, the accuracy or currency of any particular information, or the lack of viruses on our site, or that our site will display as desired in all Web browsers.
15. LIMITATION OF DAMAGES
In no event will mypokerintel.com be liable for any consequential, indirect, incidental or special damages.
REMEDIES: You agree that if mypokerintel.com violates any warranty or other provision of this Agreement, and we determine that repair or other corrective action is not economically or technically feasible, your sole and exclusive remedy will be to obtain a refund of amounts paid for services rendered for the period that said warranty was violated.
LIABILITIES: YOU AGREE THAT mypokerintel.com IS NOT LIABLE FOR ANY AMOUNT EXCEEDING THE PRICE OF YOUR CURRENT SUBSCRIPTION PRECEDING THE EVENT GIVING RISE TO ANY CLAIM. IN NO EVENT SHALL mypokerintel.com BE LIABLE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOST SAVINGS OR PROFIT, LOST DATA, BUSINESS INTERRUPTION OR ATTORNEYS FEES) EVEN IF NOTIFIED IN ADVANCE OF SUCH POSSIBILITY.
16.INDEMNITY
You agree to indemnify and hold us harmless, and pay our attorney's fees and costs, if we become liable for or incur any damages in connection with your breach of this Agreement. You may not settle any dispute without our prior written consent.
17. APPLICABLE LAWS AND DISPUTES
This Agreement is governed by the laws of the State of Nevada.
18. AMENDMENTS
mypokerintel.com may change the provisions of this agreement from time to time and it is your responsibility to check this page for updates and amendments.

mypokerintel.com is owned by Professional Analytics, LLC and its Members. No other persons are authorized to act on behalf of the site (such as entering into any agreements) without the express written permission of the owners.
